1. Acceptance of Terms
By creating an account on Festory or using the application, you agree to these Terms and Conditions in full.
If you disagree with any part, please do not use the application.
2. Age Requirement
Festory is intended exclusively for users who are 18 years of age or older. By
registering, you declare that you are at least 18 years old. We reserve the right to immediately terminate
any account that does not meet this requirement. If you are aware that a minor is using Festory, please
notify us at support@festory.io.
3. Service Description
Festory is a social platform for discovering local events and sharing photos and videos in real time. Users
can create events, join nearby events, and upload multimedia content from their experiences.
4. Registration and Account
- You must provide truthful and up-to-date information when registering.
- You are responsible for maintaining the confidentiality of your password and for all activities that occur
under your account.
- You may not transfer or share your account with third parties.
- Notify us immediately at support@festory.io if you detect
unauthorized access.
- We reserve the right to suspend or delete accounts that violate these Terms or that have been inactive for
an extended period.
5. User Content and License
When uploading photos, videos, comments, or other content to Festory:
- You retain ownership and copyright over your content.
- You grant Festory a non-exclusive, worldwide, royalty-free, transferable, and sublicensable license to
store, reproduce, display, distribute, and adapt your content solely for the purpose of operating and
improving the platform.
- This license does not authorize Festory to use your content in third-party advertising
without your explicit consent.
- You warrant that you hold all necessary rights over the content you upload, including image rights of any
person appearing in it.
- You must not upload illegal, violent, pornographic, hate-inciting content, content that reveals personal
information of third parties without their consent, or content that violates intellectual property
rights.
- Festory may remove any content that violates these Terms without prior notice.
6. Community Guidelines
In addition to these Terms, all users must respect our community guidelines:
- Share only authentic content related to the event.
- Treat all other users with respect and dignity.
- Do not spread false information, rumors, or misleading content.
- Do not use Festory to market products or services without authorization.
- Respect the privacy of people appearing in your photos or videos.
- Repeated violations may result in the permanent suspension of your account.
7. Prohibited Conduct
The following is expressly prohibited:
- Harassing, threatening, intimidating, or discriminating against other users.
- Impersonating another person, brand, or entity.
- Publishing content that infringes copyright, trademarks, or image rights.
- Using the platform for illegal, fraudulent, or spam purposes.
- Attempting unauthorized access to systems, accounts, or third-party data.
- Distributing malware, viruses, or any harmful code.
- Scraping, automated crawling, or mass data extraction from the platform.
- Interfering with the normal operation of the service or its servers.
- Creating multiple accounts to evade suspensions or restrictions.
8. Minors
Festory is not directed at persons under the age of 18 and does not knowingly collect data from minors. If
we discover that a user is a minor, we will immediately delete their account and all associated content. If
you are a parent or guardian and believe your minor child has created an account, please contact us at
support@festory.io.
9. Third-Party Image Rights
When publishing photos or videos in which other people appear:
- You must have their consent to publish their image on the platform.
- It is prohibited to publish content that exposes people without their consent in private or compromising
situations.
- Any person may request removal of their image by contacting
support@festory.io. We will evaluate the request and act
accordingly.
10. Protection of Minors Appearing in Content
Although Festory is intended exclusively for users over 18 years of age, we acknowledge that event
attendees may upload photos or videos in which minors appear. To protect their integrity, the following
rules are mandatory:
- It is expressly prohibited to publish images or videos of minors in compromising,
sexualized, violent, humiliating, or dignity- or privacy-violating situations.
- To publish content in which minors appear in a general context (for example, in a group photo at a
family event), the user must have the explicit consent of the minor's parent or legal guardian.
- If you do not have such consent, you must blur or cover the faces of the minors before publishing
the content.
- Festory adopts a zero-tolerance policy toward content that exploits, abuses, or
endangers minors. Such content will be removed immediately and the responsible account will be
permanently suspended with no possibility of appeal.
- We are committed to actively cooperating with the competent authorities upon any indication of
content constituting a crime against the integrity of minors.
Detected inappropriate content involving minors? Report it immediately to
support@festory.io with the subject
"Minor Report". We will review the report within 24 hours and act
immediately.
11. Location Data
Festory uses your geographic location to show you nearby events and to record the approximate location of
content you upload. You can control location permissions from your device settings at any time.
12. Push Notifications
With your consent, we may send you push notifications about activity in events you follow. You can disable
them from your device settings or from within the app.
13. Privacy and Personal Data
The collection and use of your personal data is governed by our
Privacy Policy. In summary:
- We collect data you provide directly (name, email address, profile photo) and data generated by your use
of the app (approximate location, events attended, content published).
- We use this data to provide and improve the service, personalize your experience, and send you relevant
communications with your consent.
- We do not sell your personal data to third parties.
- We may share aggregated, anonymized data with analytics partners to improve the service.
- You have the right to access, correct, and delete your data. To exercise this right, write to us at
support@festory.io.
14. Third-Party Services
Festory integrates third-party services to operate:
- Google Sign-In: if you choose to sign in with Google, you will also be subject to
Google's Terms of Service and Privacy Policy.
- Firebase (Google): used for push notifications and usage analytics.
- Amazon Web Services (AWS): used for photo and video storage.
- Stripe: used to process payments for public events and the Festory Pro subscription.
When making a payment on Festory, you will be redirected to Stripe's secure environment.
Festory does not store or have access to your payment card details or any financial
information. All financial data is handled exclusively by Stripe under their own security
standards (PCI-DSS). We recommend reviewing
Stripe's Terms of Service
and their Privacy Policy.
- Festory is not responsible for the privacy practices or terms of these providers. We recommend reviewing
their policies directly.
Secure payments with Stripe: Festory never stores or sees your card details. All
financial processing takes place within Stripe's certified infrastructure. If you have questions about
a charge, contact us at
support@festory.io.
The platform may contain links to third-party websites. Festory does not control or take responsibility for
the content of such sites.
15. Copyright Claims
Festory respects intellectual property rights and expects its users to do the same. If you believe your work
has been reproduced on the platform in a way that constitutes copyright infringement, you may notify us:
- By sending an email to support@festory.io with the subject
"Copyright Claim".
- Your notice must include: identification of the protected work, URL of the infringing content, your
contact details, and a good-faith statement.
- We will investigate and act promptly, including potentially removing the reported content.
- Abuse of this claims process may result in the suspension of your account.
16. Account and Content Deletion
You may request deletion of your account at any time from the app settings or by writing to
support@festory.io. Upon account deletion:
- Your profile and personal data will be deleted within 30 days.
- Content you have published (photos, videos, comments) may be deleted, although some copies may remain in
backup systems for an additional period.
- Content that other users have downloaded or shared outside the platform cannot be controlled by
Festory.
- Festory may also delete your account if you violate these Terms, with or without prior notice.
17. Indemnification
You agree to indemnify, defend, and hold harmless Festory and its officers, employees, and collaborators
from any claim, damage, loss, cost, or expense (including reasonable legal fees) arising from: (a) your use
of the platform; (b) content you publish; (c) your breach of these Terms; or (d) your violation of
third-party rights.
18. Advertising
Festory currently does not display third-party advertising within the application. If we decide to include
advertising in the future, we will notify you in advance and update these Terms. Festory will never use your
personal photos or videos as advertising material without your explicit consent.
19. Festory's Intellectual Property
All rights to the Festory application — including its design, code, logos, brand, and editorial content —
belong to Festory or its licensors. Reproduction, modification, or distribution without prior written
authorization is prohibited.
20. Limitation of Liability
To the fullest extent permitted by applicable law, Festory shall not be liable for:
- Content published by users.
- Direct, indirect, incidental, or consequential damages arising from use or inability to use the
platform.
- The truthfulness, accuracy, or legality of events published by third parties.
- Data loss, service interruptions, or security breaches caused by third parties.
21. Dispute Resolution
Before initiating any legal action, the parties agree to attempt to resolve the dispute in good faith
through direct negotiation for a period of 30 days. If no agreement is reached, any dispute shall be
submitted to the competent courts indicated in the Governing Law section. Nothing in this clause prevents you
from seeking urgent injunctive relief from a competent court.
22. Modifications
We may update these Terms at any time. We will notify you of material changes through the application or by
email at least 15 days before they take effect. Continued use of Festory after the effective date of the new
terms implies your acceptance.
23. Governing Law
These Terms are governed by the laws of the United Mexican States. Any dispute that cannot be resolved
amicably shall be submitted to the competent courts of Mexico City.
